TERMS AND CONDITIONS

 

1. Definitions

“Carrier” is W8 Couriers.

“Customer” is the person who books the carrier.

“Conditions” are the conditions of carriage and is the contract between the customer and carrier.

“Consignee” is the person to whom the carrier delivers the consignment.

“Consignment” are the items being delivered by the carrier from the customer to the consignee.

“Dangerous Goods” as defined in the Carriage of Dangerous Goods by Road Regulations 1996 as amended from (time to time) and any other substance likely to cause disease, vermin or any other hazard.

2. General

2.1 Carrier is not a common carrier and accepts consignments subject only to these conditions. No employee or sub-contractor of the Carrier can alter these conditions unless agreed, in writing, by the company director.

2.2 The Customer should be either the owner of the Consignment or is authorised by the owner to accept these Conditions.

2.3  The customer should read and accept these Terms and Conditions before they use the carrier. If any customer uses the carrier it will be expected by the carrier that the customer has read and accepted these Terms and Conditions.  

3. Sub-Contractor

3.1 The Carrier may use any Sub-Contractor to deliver the Consignment and shall provide the name, upon request, of the Sub-Contractor to the Customer.

3.2 The Sub-Contractor is bound by these Terms and Conditions.

4. Dangerous Goods

The Customer must disclose any Dangerous Goods to the Carrier, who then has the right to accept or decline the Consignment. 

5. Delivery

5.1 The Customer shall make sure the Consignment is secure and addressed in accordance with statutory requirements to be carried by road, air, rail or sea.

5.2 The Carrier will make every effort to deliver the Consignment in the shortest possible time, but these are only estimates and time is not of the essence.

6. Transit

6.1 Transit starts when the Carrier takes possession of the Consignment and ends when the Consignment is delivered to the Consignee. A printed name of the Consignee is proof of delivery by the Carrier.

6.2 Where a Consignment cannot be delivered for whatever reason, the Carrier shall inform the Customer and seek advise . Where this is not possible the Carrier shall wait a maximum of 24 hours and return the Consignment to the Customer. A charge of the delivery price will be made to the Customer unless fault lies with the Carrier.

7. Payment

7.1 Payment terms are strictly 14 days unless otherwise agreed by the company director.  

7.2 Any queries about an invoice should be made within 5 days of receipt otherwise it will be deemed as accepted by the Customer and payable within the payment terms.

7.3 All prices are quoted excluding V.A.T which will be charged at 15%.

8. Liability for Loss or Damage

Unless agreed in writing, the liability of the Carrier shall be limited to : 

8.1 A maximum of £20,000 per Consignment carried by van for loss or damage however it has happened.

8.2 The customer shall provide written proof of the value of the Consignment damaged or lost and if damaged the Carrier has the right to inspect the Consignment.

8.3 The Carrier is liable for the total time of Transit.

8.4 The Carrier is not liable for loss, damage or misdelivery of any Consignment unless it is notified by the Customer within 4 days of Transit end.

9.Indemnity to the Carrier

The Customer shall indemnify the Carrier against all losses and claims made against the Carrier whilst their Consignment is in Transit.
